Comparative Constitutional Law: Moving Beyond the Boundaries of Parochial Thinking
Comparative constitutional law involves more than simply comparing two different countries. How can the concepts, methods and working practices used by comparative constitutional lawyers enlighten and enliven the thinking of lawyers who customarily focus on one country?
This conference will explore the repertoire of ideas and methods of comparative constitutional law and look at them in the context of work done by such lawyers. Countries can seem close to the comparator country (for example the UK and Australia or Canada) others different but within the European ‘family’ such as the UK and France. Others may seem deceptively similar (for example the UK and the USA) and others remote (the UK and China) whilst still others bear multiple traditions and have, for instance, a blueprint either created or influenced by a former colonial power. What can comparisons tell us and how might they offer ideas and inspiration for change or a new way of thinking about UK constitutional law?
